Τα χρέη στο Δημόσιο, τα κέρδη στους banksters και με τον νόμο!

Οι αλλαγές που περιλαμβάνει το νομοσχέδιο για το ταμείο χρηματοπιστωτικής σταθερότητας (ΤΧΣ) εξασφαλίζουν οριστικά την επιβάρυνση του Ελληνικού Δημοσίου με περισσότερο χρέος, αφού ανοίγουν το δρόμο για ξεπούλημα των μετοχών του ΤΧΣ με μεγάλες ζημιές για το Δημόσιο.

Στο “Άρθρο δεύτερο” του πολυνομοσχεδίου, περί τροποποιήσεων του νόμου 3864/2010 “Περί ιδρύσεως ταμείου χρηματοπιστωτικής σταθερότητας”, μεταξύ άλλων:

Στη σελ.193 που αφορά την αντικατάσταση του άρθρου 7 του νόμου 3864/2010 για την χορήγηση κεφαλαιακής ενίσχυσης – έκδοση μετοχών, στο τέλος της παραγράφου 5α, αναφέρεται ότι: “Δεν επιτρέπεται η διάθεση νέων μετοχών στον ιδιωτικό τομέα σε τιμή κατώτερη της τιμής κάλυψης αυτών από το Ταμείο στο πλαίσιο της ίδιας έκδοσης. Η τιμή διάθεσης στον ιδιωτικό τομέα δύναται να είναι χαμηλότερη της τιμής προηγούμενων καλύψεων μετοχών από το Ταμείο, ή της τρέχουσας χρηματιστηριακής τιμής.”

Στη σελ.196 που αφορά την αντικατάσταση του άρθρου 8 του νόμου 3864/2010 για την διάθεση ιδίας μετοχής, παρ.4, αναφέρεται ότι: “Η τιμή διάθεσης των μετοχών από το Ταμείο στις περιπτώσεις της παραγράφου 2 και η ελάχιστη τιμή κάλυψης των μετοχών από τους ιδιώτες επενδυτές στις περιπτώσεις της παραγράφου 3 ορίζονται από το Γενικό Συμβούλιο του Ταμείου σύμφωνα με τη διαδικασία της παραγράφου 6 του άρθρου 7. Οι κατά το προηγούμενο εδάφιο οριζόμενες τιμές διάθεσης ή κάλυψης, δύνανται να είναι χαμηλότερες της τιμής κτήσης των μετοχών από το Ταμείο ή της τρέχουσας χρηματιστηριακής τιμής.”

Επίσης, στη σελ.183 παρ.5, αναφέρεται ότι: “Στο σκοπό του Ταμείου δεν εντάσσονται η παρακολούθηση και ο έλεγχος των πράξεων και αποφάσεων των οργάνων της ειδικής εκκαθάρισης πιστωτικών ιδρυμάτων. Τα μέλη των συλλογικών οργάνων του Ταμείου δεν έχουν καμία εξουσία ή αρμοδιότητα ως προς πράξεις ή παραλείψεις των οργάνων που έχουν την ευθύνη διεξαγωγής της ειδικής εκκαθάρισης πιστωτικών ιδρυμάτων.”

Μπαίνει δηλαδή μια διπλή δικλείδα ασφαλείας υπέρ των ιδιωτικών συμφερόντων, αφού ούτως ή άλλως, το Ελληνικό Δημόσιο, παρόλο που έχει οριστεί ως βασικός εγγυητής για τη διάσωση των τραπεζών, έχει ελάχιστη ως μηδενική δυνατότητα παρέμβασης στο ΤΧΣ όπως αποδεικνύεται από τα παρακάτω:

Στη σελ.200 που αφορά την αντικατάσταση της παρ.13 του άρθρου 4 του νόμου 3864/2010 αναφέρεται ότι: “Το Γενικό Συμβούλιο συνέρχεται όσο συχνά απαιτούν οι εργασίες του Ταμείου, σε κάθε δε περίπτωση δέκα (10) φορές κατ` ημερολογιακό έτος. Οι συνεδριάσεις του Γενικού Συμβουλίου συγκαλούνται από τον Πρόεδρο, ο οποίος και προεδρεύει σε αυτές. Σε περίπτωση απουσίας του Προέδρου, οι συνεδριάσεις συγκαλούνται από ένα από τα άλλα μέλη του Γενικού Συμβουλίου, εκτός του εκπροσώπου του Υπουργείου Οικονομικών και εκτός του προσώπου που ορίζεται από την Τράπεζα της Ελλάδος. Το μέλος αυτό το οποίο και προεδρεύει στη συνεδρίαση, επιλέγεται σύμφωνα με όσα ορίζονται στον Εσωτερικό Κανονισμό Λειτουργίας του Γενικού Συμβουλίου σχετικά με τη διαδικασία αναπλήρωσης του Προέδρου.”

Ήδη, με βάση το άρθρο 1 του νόμου 3864/2010, για την “Ίδρυση Ταμείου Χρηματοπιστωτικής Σταθερότητας”: “Το Ταμείο έχει πλήρη δικαιοπρακτική ικανότητα και ικανότητα να είναι διάδικος, δεν ανήκει στο δημόσιο τομέα, διαθέτει διοικητική και οικονομική αυτοτέλεια, λειτουργεί αμιγώς κατά τους κανόνες της ιδιωτικής οικονομίας και διέπεται από τις διατάξεις του παρόντος νόμου. Ο αμιγώς ιδιωτικός χαρακτήρας του Ταμείου δεν αναιρείται ούτε από την κάλυψη του συνόλου του κεφαλαίου του από το Ελληνικό Δημόσιο, ούτε από την έκδοση των προβλεπόμενων αποφάσεων του Υπουργού Οικονομικών.”


Αποδεικνύεται έτσι, ότι πράγματι, το μόνο “δημόσιο” που υπάρχει στις τράπεζες στην Ελλάδα, είναι τα χρέη που θα φορτωθούν οι επόμενες γενιές.
