Στόχος ΝΔ και ΚΙΝΑΛ η παραδειγματική εξόντωση των προστατευόμενων μαρτύρων

Η Βουλή δεν μπορεί να λειτουργεί ως πλυντήριο παραθεσμικών λειτουργιών με την επίκληση του βουλευτικού έργου

Δεν ξέρω αν υπάρχει κάτοικος αυτής της χώρας που να πιστεύει πως το σκάνδαλο Novartis δεν είναι σκάνδαλο, αλλά δεν νομίζω πως υπάρχει πολίτης που παρακολουθεί όσα συμβαίνουν και δεν έχει συμπεράνει λογικά ποιος είναι ο σκοπός της Προανακριτικής Επιτροπής.

Σκοπός είναι η αποκάλυψη και η παραδειγματική τιμωρία των προστατευόμενων μαρτύρων που έφεραν στην επιφάνεια το σκάνδαλο και τους επιφανείς συντελεστές του.

Για θυμηθείτε όταν έγιναν οι πρώτες αποκαλύψεις, οι οποίες δεν σχετίζονταν μόνο με μαρτυρίες αλλά και με έγγραφα που ξεκάθαρα περιέγραφαν πώς η Novartis είχε εξασφαλίσει ότι παράγοντες της κυβέρνησης Σαμαρά θα έκαναν όσα επιθυμούσε; Τι έκαναν οι εμπλεκόμενοι; Απάντησαν για τα έγγραφα; Απάντησαν για όσα τους βάραιναν; Δέκα νέα φάρμακα της Novartis έβαλε ο Άδωνης Γεωργιάδης σε κυκλοφορία, όσα δηλαδή απαιτούσε το εσωτερικό σχέδιο της φαρμακοβιομηχανίας. Άλλο φάρμακο το έβαλε ο Αντρέας Λοβέρδος για το οποίο τα στελέχη της Novartis περηφανεύονταν πως ήταν δική τους παρέμβαση στην κυβέρνηση.

Σε τίποτα δεν απάντησαν. Από την πρώτη στιγμή απαξίωσαν και στοχοποίησαν τους προστατευόμενους μάρτυρες. Απείλησαν πως θα τους ξεκουκουλώσουν, θα τους αποκαλύψουν, θα τους γδάρουν. Αυτός ήταν ο σκοπός και αυτό κάνουν.

Ο θεσμός του μάρτυρα δημοσίου συμφέροντος υπάρχει σε όλο τον κόσμο και τον γνωρίζουν και στην πιο απομακρυσμένη γωνιά της Ελλάδας από τις συνεχείς αναφορές σε ταινίες. Στις ταινίες μάλιστα τους προστατευόμενους μάρτυρες προστατεύουν ισχυρές δυνάμεις την ώρα που οι μαφιόζοι προσπαθούν να τους απαξιώσουν και τελικώς να τους σκοτώσουν. Οι μαφιόζοι, όχι τα μέλη του Κοινοβουλίου.

Στην Ελλάδα όμως, με ευθύνη της ΝΔ και του ΚΙΝΑΛ, οι προστατευόμενοι μάρτυρες παρουσιάστηκαν ως κουκουλοφόροι, ψευδομάρτυρες και σκευωροί. Τη μία μέρα ο μάρτυρας δημοσίου συμφέροντος καταθέτει στο FBI και προστατεύεται από τις αμερικανικές αρχές και την άλλη καταθέτει στην Ελληνική Εισαγγελία και τα κόμματα αντί να σεβαστούν την έρευνα, έχουν προαποφασίσει πως πρόκειται για σκευωρούς και σκευωρία.

Δεν υπάρχει πιο ένοχη στάση απ' αυτή. Πριν μερικά χρόνια ο Λοβέρδος με το Βενιζέλο κατηγορούσαν για σκευωρούς όσους κατηγορούσαν τον Άκη Τσοχατζόπουλο και αποκαλούσαν τους τραπεζικούς τους αριθμούς, αριθμούς τηλεφώνων. Σήμερα κάνουν το ίδιο πράγμα πιο οργανωμένα.

Από την πρώτη μέρα συνεδρίασης της Επιτροπής, σκοπός της ΝΔ και του ΚΙΝΑΛ είναι αποκάλυψη των μαρτύρων. Θα τους ζητήσουν να καταθέσουν πρόσωπο με πρόσωπο (ποια η έννοια της προστασίας τότε) και θα επιτρέψουν έτσι να εξαπολυθούν εναντίον τους αγωγές και μηνύσεις μέχρι να ισοπεδωθούν ή να αναιρέσουν. Η αρμόδια διεύθυνση της ΓΑΔΑ, έχει προτείνει με έγγραφό της, να γίνει η εξέταση των συγκεκριμένων μαρτύρων στην Προανακριτική με αλλοίωση της φωνής και της εικόνας. Η πλειοψηφία στην Προανακριτική (ναι συμπεριλαμβάνεται το ΚΚΕ) επιμένει να τους εξετάσει φόρα παρτίδα. Γιατί, εξετάζουν την εμφάνιση ή αυτά που λένε οι μάρτυρες; Τι τους ενδιαφέρει;

Πριν καταλήξουν εκεί υπήρχε άλλος πονηρός σχεδιασμός. Να ζητήσουν να καταθέσουν οι προστατευόμενοι μάρτυρες κατ' αντιπαράσταση με τα πρόσωπα που υποθέτουν πως είναι. Από την πρακτική αδυναμία να καταθέσει ο καλούμενος ταυτόχρονα ως απλός μάρτυρας και προστατευόμενος θα αποκάλυπταν την ταυτότητά του. Στη συνέχεια θα ακολουθούσαν επιτελεία δικηγόρων για να τους κάνουν το βίο αβίωτο.

Οι μάρτυρες πρέπει να τιμωρηθούν παραδειγματικά γι' αυτό που έκαναν, αλλά και για να μην υπάρξει ξανά πιθανότητα να βρεθεί προστατευόμενος μάρτυρας που θα θεωρήσει πως με την κάλυψη των Αρχών θα αποκαλύψει σκάνδαλο. Θα πάρει όλη η Επικράτεια το μήνυμα πως κανένας δεν είναι ασφαλής και προστατευμένος.

Η πλειοψηφία στην Προανακριτική επιβάλει όποια απόφαση επιλέξει να πάρει. Υπάρχει όμως ένα αδύναμο σημείο. Οι αποφάσεις που παίρνουν οι βουλευτές έχουν και ποινική ευθύνη, τα δε αδικήματα που διαπράττουν δεν έχουν τη γνωστή παραγραφή του νόμου περί ευθύνης υπουργού. Η γενική αρχή πως ο βουλευτής δεν πρέπει να διώκεται για τις επιλογές που κάνει κατά την άσκηση των καθηκόντων του δεν μπορεί να καλύψει την καραμπινάτη παράβαση καθήκοντος. Είναι σα να λέμε πως ο Εισαγγελέας δεν μπορεί να διώκεται όταν κάνει παράβαση καθήκοντος και μάλιστα με δόλο.

Η Βουλή δεν μπορεί να λειτουργεί ως πλυντήριο παραθεσμικών λειτουργιών με την επίκληση του βουλευτικού έργου, όταν το βουλευτικό έργο γίνεται έγκλημα. Όσοι λοιπόν επιπόλαια επιλέγουν τη θεσμική εκτροπή με τον τσαμπουκά της πλειοψηφίας, μπορεί να καθίσουν αύριο στο σκαμνί ή να χρειαστεί να πληρώσουν εκατοντάδες χιλιάδες σε αγωγές (στις οποίες δεν υπάρχει και βουλευτική ασυλία). Και δεν απαιτείται να το κινήσει ένα κόμμα της αντιπολίτευσης αυτό. Αρκεί και ένας πολίτης.

Το παραμύθι με τις ασυλίες του…εγκλήματος πρέπει να σταματήσει. Ας πάει μήνυση στη Βουλή για άρση ασυλίας να δούμε τι θέση θα πάρει το κάθε κόμμα.

ΥΓ: Για την αξιοπιστία της Προανακριτικής τι να πρωτοπείς. Μέλος με εισαγγελικό ρόλο είναι ο Θάνος Πλεύρης, ο οποίος είναι ταυτόχρονα και δικηγόρος του Σαμαρά που έκανε την μήνυση για την οποία συστάθηκε η Προανακριτική. Σε αυτή την Επιτροπή πέρασαν αναξιόπιστοι και καταδικασμένοι μάρτυρες οι οποίοι κατέθεσαν μύρια ψέματα για την αφεντιά μου. Η Επιτροπή ωστόσο δεν θέλησε να ακούσει τι λέω εγώ για όσα κατέθεσαν παρότι μέλη της έκαναν ειδικά ερωτήσεις για μένα και το Documento.
