Νόμος και Αταξία στην Ισπανία

Όπως και σε πολλές άλλες Δυτικές χώρες, αυτές τις μέρες, το κοινωνικό, πολιτικό και οικονομικό τοπίο στην Ισπανία, μεταστρέφεται με τρομακτικό ρυθμό. Η δημοκρατικά εκλεγμένη κυβέρνηση του Rajoy, εξακολουθεί να απολαμβάνει την απόλυτη πλειοψηφία στο κοινοβούλιο, παρά το ότι έχει χάσει κάθε ηθική νομιμοποίηση, μετά το γεγονός ότι έχει πιαστεί να βάζει το χέρι σχεδόν σε κάθε "βάζο με μπισκότα" που μπορεί να φανταστεί κανείς**. Εξακολουθεί επίσης να είναι επικεφαλής ενός συστήματος άκαμπτης κομματικής πειθαρχίας και ως εκ τούτου μπορεί να περάσει, λίγο-πολύ, οποιοδήποτε νόμο που μπορεί να φανταστεί.

Μόνο τις τελευταίες δύο εβδομάδες, έχει ανακοινώσει ένα σχέδιο νόμου και έχει περάσει άλλο ένα, που απειλούν να αναθεωρήσουν ριζικά το νομικό σύστημα της χώρας και τη δημόσια τάξη.

Πράξη 1: Ποινικοποιώντας τη Διαφωνία

Ο πρώτος από τους δύο νόμους, με τον μάλλον Οργουελικό τίτλο "Προστασία της Δημόσιας Ασφάλειας" - που αποκαλείται από τους πολέμιους του ως "Νόμος Φίμωτρο" - περιέχει 55 άρθρα, πολλά από τα οποία είναι προσανατολισμένα στην απόκτηση μεγαλύτερου ελέγχου των διαδηλώσεων.

Όπως πρόσφατα ανέφερε η Αγγλική έκδοση της El País, ο σκοπός του σχεδίου νόμου είναι να "βάλει ένα τέλος στις πρακτικές που, παρά τις προσπάθειες της κυβέρνησης, δεν έχουν κριθεί άξιες ποινικής μομφής στα δικαστήρια". Μεταξύ αυτών περιλαμβάνεται και η πράξη της συνάθροισης έξω από την έδρα του κοινοβουλίου ή άλλα δημόσια κτίρια, χωρίς τη ρητή άδεια των αρχών.

Αυτοί που θα πιάνονται να παραβιάζουν το νέο νόμο, θα μπορούσαν να αντιμετωπίσουν διοικητικό πρόστιμο μέχρι 30.000 ευρώ. Όσοι φωνάζουν συνθήματα εναντίον των αστυνομικών ή τους φωτογραφίζουν τη στιγμή του καθήκοντος, θα επιβαρύνονται με παρόμοιες κυρώσεις.

Ο νόμος θα επιτρέψει επίσης την αστυνομία να δημιουργεί «ζώνες ασφαλείας» για να αποτρέπει τις συναθροίσεις. Παρά το γεγονός ότι το προσχέδιο δεν κάνει καμία ειδική αναφορά, το μέτρο έχει σχεδιαστεί για τα stopescraches - την πρακτική της διαμαρτυρίας έξω από τις πόρτες των πολιτικών ή των μεγάλων επιχειρηματιών - καθώς και για αυθόρμητες συγκεντρώσεις για την αποτροπή εξώσεων, δύο μορφές πολιτικής διαμαρτυρίας που έχουν γίνει δημοφιλείς και οι οποίες έχουν ήδη κριθεί νόμιμες από το ανώτατο δικαστήριο της χώρας.

Ίσως το πιο παράλογο απ'όλα, είναι ότι η κυβέρνηση επιδιώκει επίσης να επιβάλει κυρώσεις με πρόστιμα ύψους μέχρι 600.000 ευρώ, σε όλες τις μορφές προσβολών που θίγουν την εικόνα της Ισπανίας. Αυτό, μπορεί να υποθέσει κάποιος ότι θα περιλαμβάνει το κάψιμο της Ισπανικής σημαίας - μια δημοφιλής πρακτική στην Καταλονία και τη Χώρα των Βάσκων - ή χρήση προσβλητικής γλώσσας, σε πλακάτ, κατά της Ισπανικής μοναρχίας ή του ίδιου του έθνους.

Όπως ήταν φυσικό, ο νόμος έχει προκαλέσει ένα θόρυβο ανησυχίας για τις πολιτικές ελευθερίες - αν και όχι τόσο όσο θα έπρεπε! Όχι μόνο αποτελεί μια τεράστια απειλή για τα θεμελιώδη δικαιώματα της ελευθερίας και των συγκεντρώσεων στην Ισπανία, απειλεί επίσης να πολιτικοποιήσει έντονα το ρόλο της αστυνομίας, καθώς και να την αποσπάσει από τις πιο παραδοσιακές της δραστηριότητες που αφορούν την καταπολέμηση της εγκληματικότητας.

Μια πηγή μου μέσα στην Mossos D'Esquadra (αστυνομία της Καταλονίας), μου είπε ότι "η κυβέρνηση έχει περάσει μια κόκκινη γραμμή με τον παρόντα νόμο. Στην πραγματικότητα, απαιτούν από εμάς να αφαιρέσουμε τα βασικά δικαιώματα των ανθρώπων που υποτίθεται ότι πρέπει να προστατεύουμε, ενώ ταυτόχρονα να επικεντρώνουμε όλο και λιγότερο τα διαθέσιμα μέσα μας στο κυνήγι πραγματικών εγκληματιών - πορτοφολάδες, διαρρήκτες, έμποροι ναρκωτικών, απατεώνες - ο αριθμός των οποίων απλά συνεχίζει να αυξάνεται."

Πράξη 2: Ιδιωτικοποιώντας την Αστυνομία

Με το μελάνι να μην έχει στεγνώσει από το νομοσχέδιο Προστασίας της Δημόσιας Ασφάλειας και τους απόηχους της δημόσιας αγανάκτησης να αντηχούν ακόμα, η κυβέρνηση πέρασε άλλη μια σειρά από νομοθεσίες για τον νόμο και την τάξη, αυτή την εβδομάδα, αυτή τη φορά με στόχο τη μαζική επέκταση του πεδίου εφαρμογής της παροχής υπηρεσιών αστυνόμευσης από τον ιδιωτικό τομέα.

Μεταξύ άλλων, οι ιδιωτικές εταιρίες ασφάλειας θα είναι σε θέση να:

  • Διεξάγουν, τόσο σε ιδιωτικούς όσο και σε δημόσιους χώρους, όλους τους απαραίτητους ελέγχους, έρευνες και προληπτικά μέτρα για την εκπλήρωση των καθηκόντων τους.
  • Να καταδιώκουν και να θέτουν υπό κράτηση υπόπτους, επίσης τόσο σε ιδιωτικούς όσο και σε δημόσιους χώρους και να τους παραδίδουν για σύλληψη στις αρμόδιες κρατικές αρχές.
  • Να περιφρουρούν τις περιμέτρους σωφρονιστικών κέντρων και τις εγκαταστάσεις κράτησης μεταναστών, καθώς και διάφορα άλλα "δημόσια" κτίρια.
  • Να εξασφαλίζουν μεγαλύτερη δικαστική προστασία για τις ίδιες. Για παράδειγμα, οποιεσδήποτε επιθέσεις κατά των ανδρών τους κατά τη διάρκεια του καθήκοντος θα έχουν τις ίδιες ποινικές συνέπειες με επιθέσεις ενάντια σε αστυνομικούς της κρατικής αστυνομίας.

Ο νέος νόμος απλώς επιβεβαιώνει τους φόβους που είχαν εδώ και καιρό οι Ισπανοί αστυνομικοί, ότι η κυβέρνηση επιδιώκει να μεταβιβάσει πολλές από τις αρμοδιότητές τους στον ιδιωτικό τομέα. Σύμφωνα με τον José Antonio Soriano, έναν επιθεωρητή της αστυνομίας στην Ισπανική περιφέρεια της Castellón, τα όλο και πιο περιορισμένα μέσα έχουν οδηγήσει σε μια γενική επιδείνωση της δημόσιας ασφάλειας, που είναι μια απαραίτητη προϋπόθεση για να δικαιολογηθεί η μεγαλύτερη συμμετοχή του ιδιωτικού τομέα.

Είναι το τέλειο παράδειγμα της πανάρχαιας πρακτικής πρόβλημα-αντίδραση-λύση: Πρώτα δημιουργείτε ένα πρόβλημα (μια δημόσια αστυνομία που έχει φτάσει στα όρια της λόγω έλλειψης μέσων), που στη συνέχεια οδηγεί σε μια αντίδραση (αυξανόμενη δημόσια δυσαρέσκεια για την υποβάθμιση του νόμου και της τάξης), που στη συνέχεια χρησιμοποιείτε για να δικαιολογήσετε τις ίδιες ακριβώς πολιτικές και τα μέτρα που θα θέλατε να εφαρμόσετε από την πρώτη στιγμή (τη μεταβίβαση πολλών βασικών λειτουργιών της δημόσιας αστυνομίας στον ιδιωτικό τομέα, πλουτίζοντας έτσι συγκεκριμένες ευνοημένες επιχειρήσεις και ιδιώτες - άνθρωποι που ο Soriano αποκαλεί "amiguitos" (φιλαράκια) της κυβέρνησης).

Και με τον τρόπο αυτό, η συντονισμένη βούληση των πλουσίων και ισχυρών ακυρώνει τις αυξανόμενες ανάγκες των φτωχών και αδύναμων, καθώς η Ισπανία - και ο κόσμος που ζούμε - παίρνει σταδιακά τη μορφή ενός νεο-φεουδαρχικού συστήματος οικονομικής και πολιτικής διακυβέρνησης. Υπόσχεται να είναι ένας κόσμος όπου η ισχύς και τα χρήματα θα διαμορφώνουν το δίκαιο. Όπου θα υπάρχει η κυβέρνηση απλά για να συλλέγει φόρους και να αναδιανέμει κεφάλαια στις τράπεζες και τις επιχειρήσεις. Και όπου όχι μόνο οι ευκαιρίες, αλλά και η ασφάλεια και η προστασία του νόμου, θα έχουν γίνει αποκλειστικό προνόμιο εκείνων που θα μπορούν να τα πληρώσουν.

Atlanta Police Violently Arrest Emory Students & Faculty to Clear Gaza Solidarity Encampment

Yanis Varoufakis Banned from Germany as Berlin Police Raid & Shut Down Palestinian Conference

Democracy Now!   As Germany intensifies its crackdown on pro-Palestinian voices, Democracy Now! spoke with Greek economist and politician Yanis Varoufakis, one of the planned speakers at a conference in Berlin last weekend that was forcibly shut down by police.
