Γαλλία: Απαγόρευσαν 155 συγκεντρώσεις με πρόσχημα την τρομοκρατία

Για κατάχρηση εξουσιας με πρόσχημα την τρομοκρατία κατηγορεί τη Γαλλία η Διεθνής Αμνηστία σε νεα έκθεση της.

Η έκθεση με τίτλο Δικαίωμα και όχι απειλή: Οι δυσανάλογοι περιορισμοί διαδηλώσεων στο πλαίσιο της κατάστασης έκτακτης ανάγκης στη Γαλλία αποκαλύπτει ότι έχουν εκδοθεί εκατοντάδες αδικαιολόγητα μέτρα που περιορίζουν την ελεύθερη κυκλοφορία και το δικαίωμα ειρηνικών διαδηλώσεων με το πρόσχημα της καταπολέμησης της τρομοκρατίας.

Μετά τις τρομακτικές επιθέσεις του Παρισιού στις 13 Νοεμβρίου 2015, η κατάσταση έκτακτης ανάγκης της Γαλλίας, ανανεώθηκε πέντε φορές κανονικοποιώντας μια σειρά παρεμβατικών μέτρων, μεταξυ των οποίων απαγορεύσεις διαδηλώσεων. Την περασμένη εβδομάδα, ο πρόεδρος Μακρόν δήλωσε πως θα ζητήσει από το κοινοβούλιο να παρατείνει τα μέτρα για έκτη φορά.

Η κατάσταση έκτακτης ανάγκης επιτρέπει στους νομάρχες να απαγορεύουν κάθε είδους συγκέντρωση ως προληπτικό μέτρο για αδιευκρίνιστους λόγους «απειλής για την δημόσια τάξη». Oι εξουσίες αυτές συχνά χρησιμοποιούνται δυσανάλογα, περιορίζοντας πολλές φορές το δικαίωμα στην ειρηνική διαδήλωση.

Μεταξύ του Νοεμβρίου του 2015 και της 5ης Μαΐου 2017, οι αρχές χρησιμοποίησαν τα παραπάνω μέτρα για να εκδώσουν 155 αποφάσεις που απαγόρευσαν δημόσιες συνελεύσεις, πέρα από την απαγόρευση δεκάδων διαδηλώσεων με την χρήση του συνηθισμένου γαλλικού νόμου. Επιπλέον, επέβαλαν 639 μέτρα που εμποδίζουν συγκεκριμένα άτομα να συμμετέχουν σε δημόσιες συνελεύσεις. Από αυτά, 574 απευθύνονταν σε άτομα που διαμαρτύρονταν για τις προτεινόμενες μεταρρυθμίσεις του εργατικού δικαίου. Σύμφωνα με δημοσιεύματα των μέσων, οι αρχές επέβαλαν δεκάδες παρόμοια μέτρα για να εμποδίσουν τους πολίτες να συμμετάσχουν σε διαμαρτυρίες μετά τον δεύτερο γύρο των προεδρικών εκλογών στις 7 Μαΐου.

Ένας διαδηλωτής για το εργατικό δίκαιο δήλωσε στη Διεθνή Αμνηστία: «Δίνουν την εντύπωση ότι χρησιμοποιούν κάθε διαθέσιμο μέσο για να επιτεθούν σε εκείνους που είναι πιο ενεργοί στο κίνημα».

Οι περιορισμοί αυτοί παραβιάζουν το τεκμήριο βάσει του διεθνούς δικαίου ότι μια κινητοποιηση πρέπει να θεωρείται ειρηνική, εκτός εάν οι αρχές μπορούν να αποδείξουν το αντίθετο.

Παρα τους περιορισμούς κατά την κατάσταση έκτακτης ανάγκης, πολλοί συνεχίζουν να διαμαρτύρονται. Ωστόσο, όσοι αγωνίζονται κατά των περιορισμών συχνά αντιμετωπίζονται με περιττή ή υπερβολική βία από τις δυνάμεις ασφαλείας. Έχουν χρησιμοποιηθεί γκλομπ, σφαίρες από καουτσούκ και δακρυγόνα εναντιον ειρηνικών διαδηλωτών.

Οι Street Medics, ανεπίσημο κίνημα πρώτων βοηθειών, εκτιμούν ότι μόνο στο Παρίσι, περίπου 1.000 διαδηλωτές τραυματίστηκαν από την αστυνομία κατά τη διάρκεια διαμαρτυριών κατά των μεταρρυθμίσεων του εργατικού δικαίου. Η Διεθνής Αμνηστία έχει δει βίντεο με τέσσερις αστυνομικούς να κλωτσούν και να χτυπούν τον Πάκο, έναν 16χρονο μαθητή, με γκλομπ πριν τον συλλάβουν. Δύο μάρτυρες δήλωσαν στη Διεθνή Αμνηστία ότι ο Πάκο δεν συμμετείχε σε κάποια βίαιη διαμαρτυρία όταν δέχθηκε επίθεση από την αστυνομία.

Ο Ζαν-Φρανσουά, ένας 20χρονος φοιτητής που έχασε το αριστερό του μάτι όταν πυροβολήθηκε από την αστυνομία με μια σφαίρα από καουτσούκ, δήλωσε στη Διεθνή Αμνηστία: «Είμαι πολύ θυμωμένος. Πριν από αυτό εμπιστευόμουν την αστυνομία».
