Να απαντήσουν Σαμαράς, Γεωργιάδης, Βορίδης μετά την απόφαση των ΗΠΑ πως βοήθησαν τη Novartis

Η απόφαση του αμερικανικού δικαστηρίου του Νιού Τζέρσι για την υπόθεση Novartis Hellas με την οποία καλείται η πολυεθνική φαρμακευτική εταιρεία να πληρώσει 310 εκατ. δολάρια κατόπιν εξωδικαστικού συμβιβασμού για αθέμιτες πρακτικές στη χώρα μας κατά την περίοδο 2012-2015 αλλάζει τελείως την πολιτική ατζέντα.

Και αυτό παρά την αγωνιώδη προσπάθεια των καλοπληρωμένων από την κυβέρνηση Μητσοτάκη Μέσων Ενημέρωσης να διαστρεβλώσουν την απόφαση του αμερικανικού δικαστηρίου υποστηρίζοντας από το βράδυ της Πέμπτης που έγινε γνωστή ότι η υπόθεση έκλεισε χωρίς αναφορά σε πολιτικά πρόσωπα. Ξεχνούν βέβαια ότι η επιτροπή κεφαλαιαγοράς των ΗΠΑ και το δικαστήριο του Νιου Τζέρσι δεν έχουν αρμοδιότητα, όπως είναι λογικό, για απόδοση ποινικών η άλλων ευθυνών σε πολίτες τρίτων χωρών.

Παρόλα αυτά οι αναφορές στη σχέση πολιτικών και κρατικών λειτουργών με τη Novartis στο πλαίσιο μάλιστα της συμφωνίας ενός εξωδικαστικού συμβιβασμού αποτελούν την απόδειξη για την σκανδαλώδη περίπτωση που εξετάζεται από την ελληνική δικαιοσύνη με την εμπλοκή πολιτικών προσώπων. 

Αντίθετα όμως, τώρα αρχίζει να παρουσιάζεται σε όλο της το βάθος η υπόθεση Novartis καθώς το αμερικανικό δικαστήριο αναφέρει στην απόφασή του ότι «οι άνθρωποι της Novartis, συνειδητά και εσκεμμένα συνωμότησαν και συμφώνησαν μεταξύ τους να διαπράξουν αδικήματα κατά των ΗΠΑ». Ανάμεσα στα αδικήματα αυτά είναι, όπως αναφέρεται στο σημείο 4: «να παρακινήσουν τους ξένους αξιωματούχους (εννοεί τους Έλληνες αξιωματούχους) να χρησιμοποιήσουν την επιρροή τους στην κυβέρνηση και τους Οργανισμούς και τα Όργανα και να επηρεάσουν τις αποφάσεις των κυβερνήσεων των Οργανισμών και των Οργάνων προκειμένου να βοηθήσουν τη Novartis Hellas».

Και εδώ αρχίζουν τα ερωτηματικά για αυτούς που κυβέρνησαν από το 2012 έως το 2015. Από τον Ιούνιο του 2012 λοιπόν έως τον Ιανουάριο του 2015 πρωθυπουργός της Ελλάδας διετέλεσε ο Αντώνης Σαμαράς που είχε διαδεχθεί τον υπηρεσιακό πρωθυπουργό Παναγιώτη Πικραμμένο. Η κυβέρνηση Σαμαρά είχε ως υπουργούς Υγείας τον Ανδρέα Λυκουρέντζο, τον Αδωνη Γεωργιάδη και τον Μάκη Βορίδη.

Άρα τώρα πρέπει ο πρώην πρωθυπουργός και οι τρεις πρώην υπουργοί Υγείας να απαντήσουν σε αυτό που αναφέρει ρητά η απόφαση του δικαστηρίου και παραδέχτηκε η Novartis. Πως δηλαδή και ποιους τρόπους βοήθησαν τη Novartis Hellas να αυξήσει την επιρροή της στην Ελλάδα. Τι εννοεί δηλαδή το αμερικανικό δικαστήριο όταν αναφέρει: 

                           Συνωμοσία για να παραβιαστούν οι κανονισμοί κατά της δωροδοκίας του νόμου FCPA (Νόμος κατά της διαφθοράς στο εξωτερικό) 42. Μεταξύ του 2012 ή περίπου του 2012 και μεταξύ του ή περίπου του 2015, εντός των Ηνωμένων Πολιτειών και αλλού, η κατηγορούμενη NOVARTIS HELLAS S.A.C.I. μαζί με το «Novartis Hellas Στέλεχος 1», το «Novartis Hellas Στέλεχος 2», και άλλους γνωστούς και αγνώστους, οι οποίοι συνειδητά και εσκεμμένα συνενώθηκαν, συνωμότησαν, συνασπίστηκαν, και συμφώνησαν μαζί και μεταξύ τους να διαπράξουν αδίκημα κατά των Ηνωμένων Πολιτειών, ως εξής: ευρισκόμενοι στο έδαφος των Ηνωμένων Πολιτειών, μέσω των εργαζομένων και των πρακτόρων της, διέπραξαν διεφθαρμένες πράξεις σε συνέχεια μιας προσφοράς, πληρωμής, υπόσχεσης για πληρωμή και εξουσιοδότηση για την παροχή ό,τιδήποτε αξίας σε αλλοδαπό αξιωματούχο και σε οποιοδήποτε πρόσωπο, γνωρίζοντας ότι όλα ή ένα μέρος αυτών των χρημάτων και πραγμάτων αξίας θα ήταν, όπως και είχαν προσφερθεί, δοθεί και υποσχεθεί σε αλλοδαπό αξιωματούχο με σκοπό να: (i) επηρεάσουν πράξεις και αποφάσεις του ως άνω αλλοδαπού αξιωματούχου υπό την επίσημη ιδιότητά του (ii) να παρακινήσουν τον ως άνω αλλοδαπό αξιωματούχο να πράξει ή παραλείψει να πράξει ενέργειες κατά παράβαση του νόμιμου καθήκοντος αυτού του αξιωματούχου (iii) να εξασφαλίσουν οποιοδήποτε παράνομο πλεονέκτημα και (iv) να παρακινήσουν τον ως άνω ξένο αξιωματούχο να χρησιμοποιήσει την επιρροή του/της εντός μιας ξένης κυβέρνησης, ως εκ τούτου να τροποποιήσουν και να επηρεάσουν ενέργειες και αποφάσεις της ως άνω κυβερνήσεως και οργανισμών και οργάνων της, προκειμένου να βοηθήσουν τη NOVARTIS HELLAS στην απόκτηση και τη διατήρηση επιχειρηματικής δραστηριότητας για αυτή και με αυτή ή να κατευθύνουν επιχειρηματική δραστηριότητα προς τη NOVARTIS HELLAS, σε αντίθεση με το 15 U.S.C. § 78dd-3.

Μήπως αυτό που αποδεικνύεται περίτρανα από τη σύγκριση των τιμών των φαρμάκων στην Ελλάδα και σε άλλες χώρες είναι ότι ένας τρόπος υπερκερδών της Novartis ήταν η υπερτιμολόγηση των φαρμάκων; Αλήθεια αν δεν υπήρχε ο περιβόητος νόμος περί ευθύνης υπουργών, που ουσιαστικά βοηθάει στην απαλλαγή υπουργών, όλοι οι υπεύθυνοι για τις υπερτιμολογήσεις των φαρμάκων την παραπάνω περίοδο που είχε ως αποτέλεσμα τη ζημία πολλών εκατομμυρίων για το ελληνικό κράτος, δεν θα έπρεπε να λογοδοτήσουν στη δικαιοσύνη;
