Θανάσιμο χτύπημα στο δικαίωμα στο άσυλο η συμφωνία ΕΕ-Τουρκίας

Η επίμονη ενασχόληση με την επιστροφή ανθρώπων στην Τουρκία αντί για τις -άνευ όρων- προσπάθειες για την μετεγκατάσταση και την παροχή άλλων ασφαλών και νόμιμων διόδων προς την Ευρώπη, φανερώνει μια ανησυχητικά κοντόφθαλμη και απάνθρωπη στάση στην αντιμετώπιση της κρίσης, ανέφερε σήμερα η Διεθνής Αμνηστία μετά τις συνομιλίες του Συμβουλίου με την Τουρκία, στο πλαίσιο της Συνόδου Κορυφής της 7ης Μαρτίου.

Ο Πρωθυπουργός Ahmet Davutoglou, ο Πρόεδρος του Ευρωπαϊκού Συμβουλίου Donald Tusk και ο Πρόεδρος της Ευρωπαϊκής Επιτροπής Jean Claude Juncker εξέθεσαν τα βασικά σημεία του σχεδίου για την τελική συμφωνία μεταξύ ΕΕ και Τουρκίας, πριν τη συνάντηση του Ευρωπαϊκού Συμβουλίου στις 17 και 18 Μαρτίου.

Η πρόταση ότι για κάθε Σύριο πρόσφυγα που θα επιστρέφεται στην Τουρκία από την Ελλάδα, ένας άλλος Σύριος θα εγκαθίσταται στην Ευρωπαϊκή Ένωση έχει σοβαρά ηθικά και νομικά ελλείμματα. Εν προκειμένω, προκαλεί ανησυχία πως το εν λόγω σχέδιο συνδέει και εξαρτά κάθε προσφερόμενη θέση μετεγκατάστασης για έναν Σύριο πρόσφυγα στην ΕΕ, με κάποιον άλλον Σύριο πρόσφυγα που θα θέτει τη ζωή του σε κίνδυνο για να διασχίσει τη θανάσιμη θαλάσσια διαδρομή προς την Ελλάδα.

“Οι ηγέτες της ΕΕ και της Τουρκίας βυθίστηκαν σήμερα σε ένα νέο, επί της ουσίας χαμηλό επίπεδο, παζαρεύοντας τα δικαιώματα και την αξιοπρέπεια μερικών από τους πιο ευάλωτους ανθρώπους στον κόσμο”, δήλωσε η Iverna McGowan, Διευθύντρια του Ευρωπαϊκού Θεσμικού Γραφείου της Διεθνούς Αμνηστίας.

Όταν οι ηγέτες της ΕΕ ρωτήθηκαν ως προς τη νομιμότητα της πρότασής τους σύμφωνα με το διεθνές δίκαιο, εκείνοι απάντησαν ότι αυτό θα μπορούσε να ρυθμιστεί εφόσον η Τουρκία χαρακτηριστεί ως «ασφαλής χώρα».

Η Διεθνής Αμνηστία αμφισβητεί έντονα την έννοια της «ασφαλούς τρίτης χώρας» γενικότερα, καθώς η εν λόγω πρακτική υπονομεύει το ατομικό δικαίωμα αίτησης ασύλου στο πλαίσιο μιας ολοκληρωμένης και δίκαιης διαδικασίας, ενώ μπορεί να καταλήξει διαδοχικά σε απελάσεις ανθρώπων στη χώρα καταγωγής τους- γεγονός που παραβιάζει την αρχή της μη- επαναπροώθησης. Ιδιαιτέρως δε στην περίπτωση της Τουρκίας, η ανησυχία είναι ακόμη μεγαλύτερη δεδομένης της παρούσας κατάστασης και μεταχείρισης των μεταναστών και των προσφύγων.

“Η Τουρκία έχει επιστρέψει εξαναγκαστικά πρόσφυγες στη Συρία ενώ πολλοί πρόσφυγες στη χώρα ζουν υπό άθλιες συνθήκες, χωρίς επαρκή στέγαση. Εκατοντάδες χιλιάδες παιδιά πρόσφυγες δεν έχουν πρόσβαση σε βασική εκπαίδευση” πρόσθεσε η Iverna McGowan.

Παρότι υπήρξε αναφορά σχετικά με τη μη επιστροφή στην Τουρκία για μη Σύριους/ες που βρίσκονται σε ανάγκη διεθνούς προστασίας, ωστόσο δεν έχει γίνει σαφής ο τρόπος κατά τον οποίο θα διασφαλίζονται εξατομικευμένα τα δικαιώματά τους σε ένα ευρύ πλαίσιο μαζικών επιστροφών. Η πραγματικότητα είναι πως δεν προέρχονται όλοι οι αιτούντες-άσυλο από τη Συρία και πως η Τουρκία δεν διαθέτει ένα ολοκληρωμένο λειτουργικό σύστημα ασύλου.

Η εν λόγω πρόταση μετατρέπει σε παρωδία την υποχρέωση της ΕΕ να παρέχει πρόσβαση σε άσυλο στα σύνορά της. Κάθε σύστημα επιστροφής, που δεν θα είναι βασισμένο στην αρχή του ατομικού δικαιώματος σε μία δίκαιη και εύρωστη διαδικασία ασύλου, είναι βαθιά προβληματικό.

“Οι Ιρακινοί και Αφγανοί υπήκοοι, μαζί με τους Σύριους, αποτελούν περίπου το 90% των αφίξεων στην Ελλάδα. Το να τους στέλνουμε πίσω στην Τουρκία ενώ γνωρίζουμε ότι το δίκαιο αίτημά τους για διεθνή προστασία δε θα εισακουστεί ποτέ, αποδεικνύει ότι οι ισχυρισμοί της ΕΕ περί σεβασμού των ανθρωπίνων δικαιωμάτων των προσφύγων είναι μόνο κούφια λόγια” δήλωσε η Iverna McGowan.

Ειπώθηκε επίσης από τον Προέδρο Tusk ότι η δίοδος των Δυτικών Βαλκανίων θα κλείσει. Αυτό θα οδηγήσει χιλιάδες ευάλωτους ανθρώπους, εγκαταλελειμμένους στο κρύο, χωρίς σαφές σχέδιο ως προς το πώς θα καλυφθούν οι ανθρωπιστικές ανάγκες και τα δικαιώματά τους για διεθνή προστασία.

Είναι επείγον, η Ευρωπαϊκή Ένωση και η διεθνής κοινότητα συνολικά, να εντείνουν τη δέσμευσή τους στην επίλυση της κρίσης, τόσο σε επίπεδο ανθρωπιστικής ή και άλλου είδους οικονομικής βοήθειας όσο και μέσω της αύξησης του αριθμού των προσφύγων προς μετεγκατάσταση.
