Θέμα: Διορισμός εποπτικού συμβουλίου ΝΕΡΙΤ, τροποποιήσεις στον Νόμο 4173/2013

Aγαπητέ κύριε Πρωθυπουργέ,

Όπως ίσως γνωρίζετε, η Ευρωπαϊκή Ένωση Ραδιοτηλεόρασης (EBU) έδειξε πολύ ενεργό ενδιαφέρον στην περσινή πρωτοβουλία για τη μεταρρύθμιση της δομής των δημόσιων ΜΜΕ στην Ελλάδα, και με τις ενέργειές της από τότε, η EBU έχει αποδείξει περίτρανα την υποστήριξή της σε αυτή την πρωτοβουλία, αν και είχε προκαλέσει τη διάλυση ενός από τα ιδρυτικά της μέλη, της ΕΡΤ. Ωστόσο, από τα τραυματικά γεγονότα του Ιουνίου του 2011 έχουμε αγωνιστεί να υποστηρίξουμε τη ΝΕΡΙΤ, όπως ωριμάζει, με την ελπίδα ότι θα γίνει ένα απολύτως κατάλληλο υποψήφιο μέλος της ΕBU αργότερα φέτος.

Mε βαθιά ανησυχία λοιπόν για το μέλλον της δημόσιας ραδιοτηλεόρασης στην Ελλάδα, μάθαμε για τη νέα διαδικασία διορισμού του Εποπτικού Συμβουλίου της ΝΕΡΙΤ, το οποίο υιοθετήθηκε/επικυρώθηκε από το Ελληνικό Κοινοβούλιο στις 5 Αυγούστου 2014.

Όπως γνωρίζετε, το κλείσιμο της ΕΡΤ, πέρυσι, ήγειρε πολλές σοβαρές ανησυχίες, τόσο εθνικά όσο και διεθνώς, για τη δημόσια ραδιοτηλεόραση και την ελευθερία και τον πλουραλισμό των οπτικοακουστικών μέσων στην Ελλάδα. Αυτές οι επικρίσεις αντισταθμίστηκαν από την άμεση δημιουργία μιας ενδιάμεσης οργάνωσης και την υπόσχεση πως η νέα δημόσια ραδιοτηλεόραση θα ήταν αποστασιοποιημένη από πολιτικές δυνάμεις. Στην πραγματικότητα ο περσινός Νόμος 4173/2013 για τη ΝΕΡΙΤ εισήγαγε έναν αριθμό σημαντικών δικλίδων ασφαλείας για την προστασία της δημόσιας ραδιοτηλεόρασης από αδικαιολόγητη πολιτική επιρροή και οι κανόνες για τον διορισμό των μελών του Εποπτικού Συμβουλίου ήταν ένα βασικό κομμάτι αυτών.

Είναι ενδιαφέρον να πούμε πως η πρόσφατη απόφαση του Ακυρωτικού Δικαστηρίου (σ.σ.: Συμβούλιο της Επικρατείας), που απέρριψε την προσφυγή ακυρώσεως της κοινής υπουργικής απόφασης που επέβαλε το κλείσιμο της ΕΡΤ, βασίστηκε ώς ένα βαθμό σε αυτή την υπόσχεση. Στην απόφασή του (παράγραφος 17), το Δικαστήριο έκανε ρητή αναφορά στις διατάξεις του Νόμου 4173/2013 οι οποίες εισήχθησαν για να διασφαλίσουν πως ο διορισμός των νέων διοικητικών οργάνων θα ήταν ανεξάρτητος από την εκτελεστική και νομοθετική εξουσία.

Εκπλησσόμαστε και απογοητευόμαστε που αυτοί οι κανόνες έχουν αλλαχθεί εν μια νυκτί, χωρίς την κατάλληλη δημόσια διαβούλευση και συζήτηση και χωρίς να λαμβάνεται υπόψη η καλύτερη πρακτική στην Ευρώπη σε ό,τι αφορά τις νομικές δικλίδες ασφαλείας για να εξασφαλιστεί μια ανεξάρτητη και πλουραλιστική σύνθεση των εποπτικών οργάνων της δημόσιας ραδιοτηλεόρασης.

Αν και κατανοούμε πως η αρχική διαδικασία διορισμού στον περσινό νόμο ήταν υπερβολικά περίπλοκη και χρονοβόρα, νιώθουμε πως η νέα διαδικασία στερείται νομικών δικλίδων ασφαλείας για την ανεξαρτησία και τον πλουραλισμό, καθώς η σύνθεση του Εποπτικού Συμβουλίου πλέον καθορίζεται από τη Διάσκεψη των Προέδρων της Βουλής με απλή πλειοψηφία, βασισμένη σε μια (μη δεσμευτική) πρόταση του υπουργού που είναι αρμόδιος για τη δημόσια ραδιοτηλεόραση.

Βέβαια, η διασφάλιση της απαραίτητης πολιτικής ανεξαρτησίας της δημόσιας ραδιοτηλεόρασης, με βάση τις προϋποθέσεις που θέτει το Συμβούλιο της Ευρώπης (συγκεκριμένα τις Συστάσεις της Επιτροπής των Υπουργών για την εγγύηση της ανεξαρτησίας της δημόσιας ραδιοτηλεόρασης -R (1996) 10- και για τη διακυβέρνηση των δημοσίων ΜΜΕ - R (2012)1), δεν είναι μόνο θέμα νομικών δικλίδων ασφαλείας αλλά και θέμα υπεύθυνης συμπεριφοράς όλων των πολιτικών φορέων.

Κατά συνέπεια, απευθυνόμαστε σε εσάς για να χρησιμοποιήσετε όλες σας τις δυνάμεις με τις οποίες σας εμπιστεύτηκαν υπό το νέο πλαίσιο για να διασφαλίσετε, συγκεκριμένα μέσα από μια ανεξάρτητη και πλουραλιστική σύνθεση του Εποπτικού Συμβουλίου, πως η ΝΕΡΙΤ θα είναι σε θέση να υπηρετήσει όλα τα κομμάτια της ελληνικής κοινωνίας, ανεξάρτητα από τις πολιτικές δυνάμεις που είναι στην εξουσία.

Γνωρίζετε όπως γνωρίζουμε και εμείς πως όλοι οι διεθνείς προβολείς είναι στην Ελληνική Βουλή και την κυβέρνηση και η διακυβέρνηση της ΝΕΡΙΤ βρίσκεται σε σταυροδρόμι: ο ένας δρόμος οδηγεί στην ολοκλήρωση του αρχικού ιδανικού -μέσα από τον διορισμό και την ισορροπημένη σύνθεση του νέου Εποπτικού Συμβουλίου- πως η διακυβέρνηση της ΝΕΡΙΤ είναι πράγματι και σε περιεχόμενο αλλά και πολιτικά ανεξάρτητη. Αν ακολουθηθεί τελικά ο άλλος δρόμος, απλά θα επιβεβαιωθούν οι επικριτές της δομής της ΝΕΡΙΤ, που ίσως ήδη να είναι κυνικοί, οι οποίοι θα δουν τις αλλαγές της περασμένης εβδομάδας ως βήμα πίσω προς το παλιό καθεστώς της πολιτικής σύμπλευσης με τη μέθοδο της διείσδυσης. Κατά τη γνώμη μας, λοιπόν, μπροστά μας είναι μια κρίσιμη στιγμή, η οποία -αν επιλεγεί ο σωστός δρόμος- μπορεί να ανακτήσει την αντίληψη για τον δημόσιο χαρακτήρα της ΝΕΡΙΤ και να καθησυχάσει εκείνους που φοβούνται πως η ΝΕΡΙΤ επανέρχεται τελώντας υπό πολιτική επιρροή.

Η EBU παραμένει έτοιμη να υποστηρίξει τη δημιουργία και περαιτέρω εξέλιξη της ΝΕΡΙΤ ως ένα ανεξάρτητο και βιώσιμο οργανισμό ΜΜΕ δημόσιου συμφέροντος, του οποίου πρωταρχικός στόχος είναι να εξυπηρετήσει το δημόσιο συμφέρον.
