EPO: εργασιακός μεσαίωνας με πατέντα

Ο Ευρωπαϊκός Οργανισμός Διπλωμάτων Ευρεσιτεχνίας συγκλονίζεται από πρωτοφανείς καταγγελίες εργαζομένων για οργουελικές συνθήκες εργασίας. Για ορισμένους είναι η κορυφή στο παγόβουνο μιας μάχης που θα καθορίσει το οικονομικό σύστημα του 21ου αιώνα

Η βάρδιά του είχε σχεδόν τελειώσει όταν άνοιξε το παράθυρο και… πήδηξε στο κενό. Λίγους μήνες αργότερα, ακόμη ένας συνάδελφός του θα προχωρούσε στο απονενοημένο διάβημα: μία ημέρα πριν τελειώσει η άδειά του και αναγκαστεί να επιστρέψει στη δουλειά, έδωσε τέλος στη ζωή του.

Οι ιστορίες θα μπορούσαν να προέρχονται από κάποιο ξεχασμένο εργοστάσιο στα βάθη της Κίνας, της Ινδίας ή του Μπανγκλαντές. Οι συγκεκριμένες αυτοκτονίες όμως (πέντε σε διάστημα τριών χρόνων) αφορούν υπαλλήλους του Ευρωπαϊκού Οργανισμού Διπλωμάτων Ευρεσιτεχνίας.

Οι «χρυσοί φυλακισμένοι», όπως του αποκαλούσε πρόσφατα η γαλλική «Le Monde», δεν μπορούν σε καμία περίπτωση να παραπονεθούν για τους μισθούς τους.

Με αποδοχές που δεν πέφτουν κάτω από τα 5.000 ευρώ τον μήνα και δεκάδες ειδικά προνόμια (συμπεριλαμβανομένων ιδιωτικών σχολείων για τα παιδιά) οι υπάλληλοι του EPO μπορούν εύκολα να κατηγορηθούν ότι παραπονιούνται για τα λεγόμενα «προβλήματα του πρώτου κόσμου» – ανούσια ζητήματα που δεν αξίζουν ούτε για μονόστηλο σε εφημερίδα.

Τα τελευταία πέντε χρόνια όμως και συγκεκριμένα από τη στιγμή που ανέλαβε πρόεδρος ο Γάλλος Μπενουά Μπατιστελί, ένα κλίμα φόβου πλανιέται πάνω από τα κεντρικά γραφεία του οργανισμού στο Μόναχο και τη Χάγη. Μπορούσα να διαβάσω αυτό τον φόβο στα μάτια ενός υπαλλήλου που δέχθηκε να μου μιλήσει για τις νέες συνθήκες εργασίας, υπό καθεστώς ανωνυμίας.

Τα μέτρα ασφαλείας που έλαβε για τη συνάντησή μας στις Βρυξέλλες και η κρυπτογραφημένη αλληλογραφία με την οποία μου ζήτησε να συνομιλούμε στο εξής θύμιζαν «τρελαμένο» οπαδό θεωριών συνωμοσίας.

Γρήγορα όμως συνειδητοποίησα ότι είχαν απόλυτο νόημα (τα ίδια μέτρα άλλωστε φαίνεται ότι έλαβε και μια άλλη πηγή που μίλησε την περασμένη εβδομάδα στη «Monde»). Ο συνομιλητής μου μου περιέγραφε τον έλεγχο της αλληλογραφίας, τις απολύσεις συνδικαλιστών αλλά και τους μηχανισμούς που έχει στήσει η διεύθυνση για να μπλοκάρει τα e-mails που στέλνει το συνδικάτο (SUEPO) στους υπαλλήλους.

Το συνδικάτο έχει καταγγείλει δημοσίως ότι οι αυτοκτονίες σχετίζονται με τις νέες συνθήκες εργασίας που καθιέρωσε ο Μπατιστελί. Αρκετοί ευρωβουλευτές μάλιστα (με προεξάρχουσα την Κωνσταντίνα Κούνεβα) καταγγέλλουν καταστρατήγηση θεμελιωδών δικαιωμάτων της Συνθήκης και του Χάρτη Θεμελιωδών Δικαιωμάτων της Ε.Ε.

Παρ’ όλα αυτά, οι ευρωπαϊκές κυβερνήσεις (και φυσικά ακόμη και το κόμμα της κ. Κούνεβα) φαίνεται ότι προτιμούν να μην αγγίζουν την υπόθεση. Από την πλευρά του ο πρόεδρος του EPO διαψεύδει όλες τις καταγγελίες των συνδικάτων με την άνεση που του προσφέρει το καθεστώς ασυλίας των διεθνών οργανισμών.

Ο EPO αποτελεί ένα ανεξάρτητο «κρατίδιο» σε ό,τι αφορά την ευρωπαϊκή νομοθεσία. Είναι χαρακτηριστικό ότι ακόμη και όταν οι καταγγελίες των συνδικάτων έφτασαν σε δικαστήριο της Ολλανδίας, το οποίο έκρινε ότι η ασυλία αυτή δεν μπορεί να ισχύει όταν παραβιάζονται ανθρώπινα δικαιώματα, ο EPO δήλωσε ανερυθρίαστα ότι θα αγνοήσει τη δικαστική απόφαση.

Πέρα όμως από τα εργασιακά δικαιώματα, οι καταγγελίες χτυπούν μια πολύ πιο σημαντική χορδή που θα καθορίσει τις πατέντες στην Ευρώπη του 21ου αιώνα. Ο EPO αποτελεί τη δεύτερη μεγαλύτερη διακυβερνητική αρχή στην ευρωπαϊκή ήπειρο και κατέχει κομβικό ρόλο στις διαπραγματεύσεις για τις συμφωνίες εμπορίου με τις ΗΠΑ. Κάθε χρόνο ελέγχει και πιστοποιεί χιλιάδες πατέντες, οι οποίες προέρχονται από κλάδους που συμμετέχουν σε ποσοστό 40% στο ΑΕΠ της Ε.Ε. και αφορούν το 35% της απασχόλησης.

Οι ασφυκτικές πιέσεις προς το προσωπικό του EPO σημειώνονται καθώς βρίσκονται σε εξέλιξη ιστορικές αλλαγές για τη δημιουργία ενός ενιαίου συστήματος που θα διαχειρίζεται τα διπλώματα ευρεσιτεχνίας (unitary patent) για όλες τις χώρες-μέλη της Ε.Ε.

Το νέο σύστημα, που προκαλεί ήδη ρίγη ευτυχίας στις μεγαλύτερες πολυεθνικές της Ευρώπης, θα στερήσει σημαντικά εργαλεία ελέγχου από τα εθνικά κοινοβούλια σε θέματα που μπορούν να καθορίσουν την τύχη ολόκληρων οικονομιών. Παράλληλα, μέσα από διαδικασίες fast track θα περιορίσει σε τρομακτικό βαθμό τους ελέγχους που πραγματοποιούσε το εξειδικευμένο προσωπικό του EPO για κάθε πατέντα αντιγράφοντας το αμερικανικό μοντέλο.

Η σημασία που αποδίδουν οι μεγάλες επιχειρήσεις, κυρίως της Γερμανίας, της Γαλλίας και της Βρετανίας, ήταν ξεκάθαρη πριν και μετά το δημοψήφισμα για το Brexit, όταν όλοι φοβόντουσαν ότι η βρετανική έξοδος θα τίναζε στον αέρα το ενιαίο σύστημα διπλωμάτων ευρεσιτεχνίας και μαζί τις διαπραγματεύσεις που πραγματοποιούνταν για δεκαετίες πίσω από κλειστές πόρτες.

Για τις οικονομικές ελίτ της Ευρώπης το ενιαίο σύστημα μπορεί να αποτελέσει ένα πολύτιμο όπλο στους κλιμακούμενους εμπορικούς πολέμους με τις ΗΠΑ και την Κίνα. Η σημερινή δομή του οργανισμού όμως δεν προσφέρεται για συνθήκες πολέμου, όπου λέξεις όπως ποιότητα προϊόντων και δημοκρατία θεωρούνται ύβρις. Και τα πρώτα θύματα σε αυτό τον πόλεμο είναι μέχρι στιγμής οι εργαζόμενοι του EPO.
