Γιατί η υπόθεση Βατοπεδίου είναι σκάνδαλο και τι σημαίνει η απόφαση αθώωσης των εμπλεκόμενων

Η αθώωση των 14 κατηγορούμενων για την υπόθεση της Μονής Βατοπεδίου και των ανταλλαγών εκτάσεων με το Δημόσιο προκάλεσε ιδιαίτερη ευφορία στους άμεσα ή έμμεσα εμπλεκόμενους, οι οποίοι προσπαθούν εναγωνίως να πείσουν ότι δεν υπήρχε σκάνδαλο. Τα πράγματα ωστόσο δεν είναι ακριβώς έτσι.

Αντιθέτως, εκείνο που κρίθηκε και αποφασίστηκε είναι πως οι κατηγορούμενοι δεν είχαν δόλο. Σύμφωνα δηλαδή με το δικαστήριο, δεν αποδείχθηκε απλώς η ηθική αυτουργία, ενώ προέκυψε -κατά το δικαστήριο- πως ό,τι έκαναν οι μοναχοί το έκαναν από την πεποίθησή τους πως η λίμνη ανήκει στη Μονή.

Το σκάνδαλο του Βατοπεδίου που αποκαλύφθηκε το 2008 προκαλώντας πολιτικό σεισμό κρίθηκε ωστόσο με την απόφαση 197/2015 του τριμελούς Εφετείου Κομοτηνής, το οποίο έκρινε πως η λίμνη Βιστωνίδα και οι παραλίμνιες περιοχές ανήκουν στο Δημόσιο και επομένως κακώς ανταλλάχθηκαν.

Το εν λόγω δικαστήριο αποτελούμενο από τους Χρήστο Τζανέρικο, Μυρσίνη Παπαχίου και Μιχάλη Κακαμανούδη, απέρριψε συγκεκριμένα στο σύνολό της την αγωγή του Βατοπεδίου εναντίον του ελληνικού Δημοσίου. Η απόφαση εκείνη πέρα από το ότι αναγνώριζε στο Δημόσιο την κυριότητα της λίμνης καθιστούσε και όλες τις μεταβιβάσεις που είχαν γίνει άκυρες.

Έχει ενδιαφέρον ότι και η πρωτόδικη απόφαση του δικαστηρίου στην Κομοτηνή, δικαίωνε εν μέρει το Δημόσιο, ωστόσο αυτό είχε αποκρυφτεί. Μάλιστα η συγκεκριμένη απόφαση δεν καθαρογράφηκε ποτέ από την τότε πρόεδρο του Δικαστηρίου, Μαρία Ψάλτη και δημοσιεύθηκε με καθυστέρηση τεσσάρων ετών! Πριν λοιπόν γνωστοποιηθεί η απόφαση, η μονή Βατοπεδίου είχε μεθοδεύσει να πάρει τη λίμνη με παράνομες υπουργικές αποφάσεις.

Στην υπόθεση αυτή είχαν πρωταγωνιστήσει ο τότε υφυπουργός Οικονομικών, Πέτρος Δούκας, ο αποθανών πρώην υπουργός Αγροτικής Ανάπτυξης Ευάγγελος Μπασιάκος και ο τότε υφυπουργός Αγροτικής Ανάπτυξης Αλέξανδρος Κοντός, των οποίων τα πιθανά αδικήματα παραγράφηκαν με το εσπευσμένο κλείσιμο της Βουλής από την κυβέρνηση Καραμανλή τον Μάιο του 2009.

Με τις υπουργικές αποφάσεις αυτές, ο κ. Δούκας σταμάτησε τη νομική διαδικασία η οποία ήταν υπέρ του ελληνικού Δημοσίου και αναγνώρισε πως οι εκτάσεις ανήκαν στη Μονή Βατοπεδίου. Στη συνέχεια με νόμους των άλλων υπουργών, ξεκίνησαν οι γνωστές ανταλλαγές των εκτάσεων της λίμνης Βιστωνίδας με άλλα ακίνητα - φιλέτα του Δημοσίου σε ολόκληρη τη χώρα.

Εξαιτίας της παραγραφής των αδικημάτων των εμπλεκόμενων πολιτικών προσώπων, οι οποίοι καλύπτονταν από τον εκτρωματικό νόμο περί ευθύνης υπουργών παραπέμφθηκαν σε δίκη τα μη πολιτικά πρόσωπα μόνο, τα οποία σήμερα κρίθηκαν αθώα. Η απαλλαγή τους από τις κατηγορίες όμως δεν αφορά το σκανδαλώδη τρόπο ανταλλαγής των εκτάσεων, ο οποίος έχει πιστοποιηθεί από τη Δικαιοσύνη με την απόφαση 197/2015. Στηρίζεται αντιθέτως μόνο στην παραδοχή πως οι εμπλεκόμενοι δεν είχαν δόλο αλλά βαθιά πίστη πως η λίμνη ανήκε στο Δημόσιο. Στην παραδοχή δηλαδή, πως δεν γνώριζαν.
