Φυλακές “τύπου Γ”: Ένα νέο πεδίο δοκιμών στο Ελληνικό πείραμα

Η νεοφιλελεύθερη κυβέρνηση συναγωνίζεται το Αμερικανικό αστυνομικό κράτος με πρωτοφανή μέτρα στο προσεχές νομοσχέδιο

Μετά την διάλυση των εργασιακών δικαιωμάτων στην Ελλάδα και τις πρώτες απόπειρες ποινικοποίησης των διαδηλώσεων, η κυβέρνηση ετοιμάζει νέα, πρωτοφανή μέτρα ενίσχυσης του αστυνομικού κράτους, με τις αποκαλούμενες φυλακές “τύπου Γ”.

Μιλώντας στον ραδιοφωνικό σταθμό “Στο κόκκινο”, η Ιωάννα Δρόσου, μέλος της Πρωτοβουλίας για τα Δικαιώματα των Κρατουμένων, αποκάλυψε τα βασικότερα σημεία του υπό ψήφιση νομοσχεδίου για τις φυλακές “τύπου Γ”.

Το πρώτο πράγμα που κάνει εντύπωση είναι ότι δεν προβλέπεται καμία κτιριακή αλλαγή για τις νέες φυλακές. Θα περίμενε κανείς ότι οι νέες φυλακές "ειδικού τύπου", θα έπρεπε να έχουν και τις ανάλογες προδιαγραφές. Παρόλα αυτά, το μόνο πράγμα που θα αλλάξει στις ήδη υφιστάμενες φυλακές, ή, σε τμήματα υφιστάμενων φυλακών, θα είναι η ονομασία τους ως φυλακές "τύπου Γ".

Οι κρατούμενοι που προορίζονται γι'αυτές τις φυλακές, θα χωρίζονται σε δύο κατηγορίες. Στην πρώτη κατηγορία, στην οποία ανήκουν αυτοί που έχουν καταδικαστεί για εγκληματική οργάνωση, ή, για εσχάτη προδοσία, θα κρατούνται στις συγκεκριμένες φυλακές για δέκα συνεχή χρόνια και μετά θα επανεξετάζεται εάν θα συνεχιστεί η κράτησή τους ανά διετία! Την απόφαση παίρνει μόνο ένας άνθρωπος, ο/η εισαγγελέας εφετών και μόνο ο υπουργός δικαιοσύνης θα έχει το δικαίωμα να αποφασίσει εάν θα γίνει τελικά η μεταγωγή του κρατουμένου στις φυλακές "τύπου Γ" ή όχι. Ο ίδιος ο κρατούμενος θα έχει δικαίωμα ένστασης μόνο μία φορά και αυτό εντός 10 ημερών, το οποίο ουσιαστικά είναι ένα τυπικό σημείο.

Στη δεύτερη κατηγορία κρατουμένων θα περιλαμβάνονται αυτοί που έχουν καταδικαστεί από 10 χρόνια και πάνω και θεωρούνται ότι είναι επικίνδυνοι για την ασφάλεια της φυλακής, ή την ασφάλεια της χώρας, ή τη δημόσια τάξη. Στις συγκεκριμένες φυλακές θα κρατούνται για 4 συνεχή χρόνια και μετά εξετάζονται ανά 2ετία.

Όποιος οδηγείται σ'αυτή τη φυλακή δεν θα παίρνει άδειες, δεν θα έχει τον ευεργετικό υπολογισμό από τα μεροκάματα και την εκπαίδευση, δεν θα έχει δικαίωμα στα μεροκάματα ούτε στη συμμετοχή του σε εκπαιδευτικά προγράμματα, θα έχει πολύ αυστηρούς περιορισμούς στην επικοινωνία του, τηλέφωνα-επισκεπτήρια, δεν θα δικαιούται ελεύθερη διαβίωση, δεν θα δικαιούται να βγει νωρίτερα και στην ουσία, δεν θα δικαιούται τίποτα.

Από μία πρώτη μελέτη, μάλλον αυτό το νομοσχέδιο είναι μια παγκόσμια πρωτοτυπία. Στο εξωτερικό προβλέπονται τέτοιες φυλακές, όμως είναι πειθαρχικές φυλακές για έξι μήνες και όχι για τέσσερα ή δέκα χρόνια. Οι έξι μήνες είναι το μέγιστο χρονικό διάστημα στην περίπτωση που κάποιος κρατούμενος προβεί σε κάποιο αδίκημα μέσα στη φυλακή. Από κει και πέρα επιστρέφει στην κανονική φυλακή.

Είναι γνωστό ότι στις Ελληνικές φυλακές υπάρχουν απάνθρωπες συνθήκες κράτησης. Είναι χαρακτηριστικό ότι, η Ελλάδα έχει τους περισσότερους ισοβίτες στην Ευρώπη, περίπου 1200, ενώ σε άλλες χώρες είναι 100-200. Αυτή τη στιγμή υπάρχουν περίπου 13.000 κρατούμενοι και η χωρητικότητα των υφιστάμενων φυλακών είναι 9.500 και αυτό υπολογίζοντας μόνο τους κρατούμενους που βρίσκονται στις φυλακές, όχι αυτούς που περιμένουν στα κρατητήρια, που είναι γύρω στις 3.500 για να μπούνε στις φυλακές. Κάτω από αυτές τις συνθήκες, ο μόνος τρόπος των φυλακισμένων για να διεκδικήσουν τα δικαιώματά τους είναι η διαμαρτυρία και είναι προφανές ότι ο νόμος για τις φυλακές "τύπου Γ", έχει σαν στόχο, καταρχήν, την πλήρη καταστολή μέσα στις ίδιες τις φυλακές κάτω από τις παρούσες απάνθρωπες συνθήκες.

Προβλέπεται ότι, η φυλακή Δομοκού θα μετατραπεί εξολοκλήρου σε φυλακή "τύπου Γ" και από κει και πέρα σε κάθε φυλακή θα δημιουργηθούν ανάλογα τμήματα.

Είναι φανερό ότι ενισχύεται σημαντικά το κράτος καταστολής, καθώς το πείραμα στην Ελλάδα πρέπει να ολοκληρωθεί πάση θυσία. Η προσπάθεια για την μεγαλύτερη ποινικοποίηση των διαδηλώσεων, θα διευρύνει σημαντικά το πεδίο ορισμού του ανθρώπου που είναι επικίνδυνος για την "ασφάλεια της χώρας, ή τη δημόσια τάξη". Αν όλα αυτά συνδυαστούν και με την πρόθεση της Ελληνικής αστυνομίας να προμηθευτεί μη επανδρωμένα αεροσκάφη, τα αποκαλούμενα "Drones" (http://www.tvxs.gr/news/ellada/drones-o-ekseligmenos-%C2%ABmegalos-adelfos%C2%BB-erxetai-stin-ellada), για πάσης φύσης υποκλοπές και παρακολουθήσεις, τότε εύκολα μπορεί να καταλάβει κανείς που οδηγούνται τα πράγματα.

A response to misinformation on Nicaragua: it was a coup, not a ‘massacre’
