Καλά που δεν πάθαμε και τίποτα

Επειδή η υπόθεση με τον Παύλο Πολάκη και οι επιθέσεις εναντίον του (ειδικά αυτή που έγινε για όσα δήλωσε για τη Δικαιοσύνη) έχουν καταντήσει ανέκδοτο, θα καταφύγω στους συμβολισμούς ενός ανέκδοτου.

Υπήρχε λοιπόν σύμφωνα με το ανέκδοτο κάποτε, ένας νταλικιέρης, ο οποίος ήταν γνωστός σε όλη την πιάτσα για την επικίνδυνη οδήγησή του. Σε ένα ταξίδι του από την Θεσσαλονίκη προς την Αθήνα, σταμάτησε και πήρε έναν άγνωστο που του έκανε auto stop. Λίγο πριν τη Λάρισα, ο νταλικιέρης, μπαίνοντας επικίνδυνα σε μία στροφή, χτύπησε ένα σκύλο που διέσχιζε το δρόμο. Το σκυλί έπεσε τραυματισμένο στην άκρη του δρόμου. Ο νταλικιέρης βγήκε από το όχημα και τραβώντας από την τσέπη του ένα όπλο, πυροβόλησε το κακόμοιρο το σκυλί αντί να το φροντίσει.

Στη συνέχεια επέστρεψε στη νταλίκα, δίπλα στον απορημένο συνεπιβάτη του και είπε «για να μην ταλαιπωρείται»… Λίγα χιλιόμετρα πιο πέρα, με την ίδια επικίνδυνη οδήγηση, ο νταλικέρης χτύπησε μία γελάδα. Βγήκε και πάλι από τη νταλίκα και πυροβόλησε το τραυματισμένο ζώο λέγοντας «για να μην ταλαιπωρείται». Ο συνεπιβάτης του δειλά δειλά του είπε να είναι πιο προσεκτικός στην οδήγηση, αλλά ο νταλικιέρης με αυτοπεποίθηση και χαμόγελο συνέχισε, για να χτυπήσει λίγο αργότερα και μια γριούλα. Βγήκε και πάλι από το όχημα και την αποτέλειωσε με τη γνωστή φράση «για να μην ταλαιπωρείται». Συνέχισε ατάραχος το ταξίδι του δίπλα στον σοκαρισμένο συνεπιβάτη.

Έξω από τη Λαμία, σε μια απότομη στροφή, η νταλίκα αναποδογύρισε και ο επιβάτης πετάχτηκε από το παρμπριζ αιμόφυρτος στο οδόστρωμα. Ο νταλικιέρης δεν έπαθε το παραμικρό. Πλησίασε τον τραυματισμένο συνεπιβάτη του, ο οποίος ήταν σε άθλια κατάσταση, και έβγαλε και πάλι το όπλο σημαδεύοντάς τον. Τότε, ο τραυματισμένος, σύρθηκε με κόπο, μάζεψε τα τσακισμένα του μέλη, έσπρωξε τα έντερά του που είχαν βγει έξω, προς τα μέσα, στηρίχτηκε με πόνο για μερικά δευτερόλεπτα και ψιθύρισε «ευτυχώς που δεν πάθαμε και τίποτα» ελπίζοντας προφανώς πως έτσι θα γλυτώσει.

Η ελληνική Δικαιοσύνη είναι με τα έντερα έξω, αιμόφυρτη, τραυματισμένη απ' όσα σκανδαλώδη συμβαίνουν στο εσωτερικό της, ισοπεδωμένη από τη νταλίκα της διαφθοράς, αλλά «ευτυχώς που δεν έπαθε και τίποτα».

Ο Παύλος Πολάκης, ως πολίτης αυτής της χώρας, δήλωσε αυτό που ξέρει και βλέπει η κοινωνία. Δεν υπάρχει Δικαιοσύνη. Και για να μην υπάρχει Δικαιοσύνη, δεν αρκεί κάποιοι, έστω πολλοί, να είναι κακοί, αλλά αρκούν και οι ελάχιστοι κακοί για να καθορίσουν την εικόνα.

Τι να κάνουν, λοιπόν, οι δικαστές και οι εισαγγελείς, να γίνουν θεοί; Προφανώς και όχι. Αρκεί να έχουν τη θεσμική λειτουργία και το θάρρος για να ξεκαθαρίζουν κάθε φορά το χώρο τους. Γιατί δεν πρόκειται απλώς για ένα επάγγελμα που θα συνοδεύεται από παθογένειες όπως όλα τα επαγγέλματα, αλλά για ένα λειτούργημα που ορίζει την κοινωνία και τη Δημοκρατία.

Δεν έχει νόημα να επαναλαμβάνουμε το κλισέ πως έχουμε εμπιστοσύνη στην ελληνική Δικαιοσύνη, ούτε το αυτοδικαιολογητικό μότο, πως δεν είναι όλοι διεφθαρμένοι. Προφανώς και όχι. Οπότε, τι νόημα έχουν οι ανακοινώσεις της Ένωσης Δικαστών και Εισαγγελέων που υπεραμύνονται αυτού του συμπεράσματος; Δεν έχει νόημα να σημειώνουν το αυτονόητο, αλλά να αντιμετωπίζουν αυτό που είναι απειλή. Ή για να το πω διαφορετικά, πρέπει να βρουν το θάρρος, να πουν αυτά που λένε οι ίδιοι στις κατ ιδίαν συζητήσεις για το ποιός καταδυναστεύει τη Δικαιοσύνη και ποιοί τη χειραγωγούν. Αυτό έχει ανάγκη η κοινωνία. Θαρραλέα στάση απέναντι στην πραγματικότητα για να μπορέσει να αντιμετωπιστεί.

Η τακτική να αντιμετωπίζεται συνδικαλιστικά και συνεταχνιακά η πανθομολογούμενη ανυπαρξία απόδοσης Δικαιοσύνης είναι το ίδιο επικίνδυνη με τη διαφθορά. Το έχω ξαναγράψει, η πλειοψηφία των λειτουργών της Δικαιοσύνης είναι τίμιοι. Ίσως όμως να μην είναι αρκετά θαρραλέοι για να κατακτούν το ύψος του ρόλου τους κάθε μέρα. Είναι άνθρωποι που πιέζονται και γνωρίζουν καλά πως το σύστημα μπορεί να τους καταστρέψει αν σηκώσουν κεφάλι. Το σύστημα όμως είναι οι διεφθαρμένοι, οι ελάχιστοι έστω και όχι οι τίμιοι. Έτσι, το αποτέλεσμα είναι ένα: Δεν αποδίδεται Δικαιοσύνη.

Δεν υπάρχει έλληνας πολίτης, που αν ρωτηθεί στο δρόμο τυχαία, θα απαντήσει πως σε αυτή τη χώρα υπάρχει Δικαιοσύνη. Δεν έχει νόημα λοιπόν, να απαντά κάποιος σε αυτό το δυσάρεστο φαινόμενο με τα περί «τιμιότητας των δικαστών». Η τιμιότητα δεν μπορεί να αντιμετωπίσει τις παθογένεις και τα κυκλώματα χωρίς θάρρος. Εκεί πρέπει να εντοπιστεί η συνδικαλιστική δραστηριότητα και όχι σε οργισμένες ανακοινώσεις κατά του Πολάκη, ο οποίος καταθέτει όσα λέμε όλοι μας στις παρέες μας. Τα συνδικαλιστικά όργανα των δικαστών και των εισαγγελέων πρέπει να προστατέψουν τους λειτουργούς εκείνους που κάνουν επικίνδυνα της δουλειά τους. Που αυτή την περίοδο, είναι σε μάχη με τη διαπλοκή που χάνει την ατιμωρισία και την παντοδυναμία της. Αυτό νομίζω θα είναι συνεισφορά στη Δικαιοσύνη και όχι οι συντεχνιακές ανακοινώσεις και οι λεκτικές διαβεβαιώσεις.

Η απερχόμενη Εισαγγελέας του Αρείου Πάγου, διέταξε έρευνα για όσα είπε ο Πολάκης. Αυτό και αν είναι υποκρισία. Η υπό πειθαρχικό έλεγχο, Ευτέρπη Κουτζαμάνη, αφού έχει καταπιεί κάμηλους κυρίως στο θέμα Βγενόπουλου, διέταξε έρευνα για την αξιολόγηση και τη γνώμη ενός πολιτικού.

Είναι επίσης υποκριτικό και εμπεριέχει πολιτικές σκοπιμότητες η επίθεση στον Πολάκη με το επιχείρημα «αν έχει στοχεία να τα καταθέσει». Τα στοιχεία είναι ολόγυρα. Στις στατιστικές για το πόσοι εγκληματίες του λευκού κολάρου φυλακίζονται σε σχέση με τους πορτοφολάδες. Στα δύο παραδικαστικά για τα οποία σχηματίστηκαν δικογραφίες. Σε όσα δημοσιοποιούνται για Εισαγγελείς σχετικά με τη δικογραφία Βγενόπουλου και στην ανταποδοτική επίθεση που έγινε στην ίδια την Πρόεδρο του Αρείου Πάγου. Κυρίως όμως σε αυτά που σχολιάζει κάθε μέρα η ίδια η κοινωνία.

A response to misinformation on Nicaragua: it was a coup, not a ‘massacre’

There is so much misinformation in mainstream corporate media about recent events in Nicaragua that it is a pity that Mary Ellsberg’s article for Pulse has added to it with a seemingly leftish critique.
