Ένα ακόμη σκάνδαλο στο Ευρωκοινοβούλιο

"Δεν ντρέπονται καθόλου",όπως γράφει και το πλακάτ των διαδηλωτών. Μόλις μια εβδομάδα μετά τα Panama Papers, που αποκάλυπταν τις χιλιάδες offshore που είχαν στήσει προσωπικότητες και εταιρείες για να φοροδιαφεύγουν, τι νομίζετε ότι ψήφισε η πλειοψηφία του Ευρωπαϊκού Κοινοβουλίου; Την νομική προστασία των μυστικών των εταιρειών, απέναντι σε πιθανές απόπειρες να δοθούν στη δημοσιότητα!

Μέσα στα επόμενα 2 χρόνια, τα 28 κράτη μέλη είναι υποχρεωμένα να προσαρμόσουν την νομοθεσία τους, έτσι ώστε τα μυστικά των επιχειρήσεων να προστατεύονται καλύτερα και όσοι τολμήσουν να τα αποκαλύπτουν να διώκονται περισσότερο από ότι σήμερα. Την πρωτοβουλία για την νέα νομοθεσία είχε το Ευρωπαϊκό Λαϊκό Κόμμα της κυρίας Μέρκελ, του κυρίου Σόιμπλε (και της ΝΔ), με το επιχείρημα ότι όλο και περισσότερες επιχειρήσεις πέφτουν θύματα διαρροών και βιομηχανικής κατασκοπείας.

Στην πραγματικότητα ήταν το ενωμένο λόμπι μιας σειράς μεγάλων πολυεθνικών εταιριών, όπως οι Intel, Alstom, Michelin, Solvay, Safran, Nestlé, General Electric κλπ που επέβαλλαν την πολιτική τους στο Ευρωπαϊκό Κοινοβούλιο εξασφαλίζοντας την σύμφωνη γνώμη των (νεο)Φιλελεύθερων του Φέρχοφστατ και δυστυχώς των λεγόμενων Σοσιαλιστών. Μόνο οι Πράσινοι και η Ομάδα της Αριστεράς αντιτάχθηκαν. Και όλα αυτά ενώ πάνω από 500.000 πολίτες είχαν υπογράψει ένα κείμενο, στο οποίο χαρακτήριζαν την νέα νομοθεσία ως σοβαρή απειλή στο δικαίωμα των πολιτών στην πληροφόρηση και ζητούσαν να αποσυρθεί.

Με βάση το νέο καθεστώς, αν οι επιχειρήσεις θεωρήσουν ότι οποιαδήποτε διαρροή στα ΜΜΕ μυστικών ή απλώς δεδομένων τους, προκαλεί οικονομική ζημιά έχουν την δυνατότητα να προσφύγουν στα δικαστήρια ζητώντας αποζημίωση. Απορρίφθηκε επίσης η τροπολογία των Πρασίνων και της Αριστεράς που ζητούσε στην οδηγία να ορίζεται σαφώς ότι οι δημοσιογράφοι δεν μπορούν να καταδικαστούν επειδή κάνουν την δουλειά τους.

Σύμφωνα με τους εισηγητές της πλειοψηφίας, εναπόκειται στα δικαστήρια να αποφασίσουν αν οι δημοσιογράφοι παραβιάζουν τον νόμο. Καλύτερα, οι τελευταίοι θα αποφασίζουν αν θα πρέπει να ριψοκινδυνεύσουν χρήματα και προσωπική ελευθερία, βάζοντας τα με την τεράστια δύναμη των πολυεθνικών εταιρειών. Η όλη υπόθεση γίνεται ακόμη πιο σαφής αν εφαρμοστεί στη πρόσφατη υπόθεση των Panama Papers. Η ίδρυση και κατοχή μιας offshore εταιρείας δεν είναι παράνομη,ώστε να μπορούσε να υποστηριχθεί στα δικαστήρια από τους κατηγορούμενους ότι προχώρησαν στη δημοσίευση για την αποκάλυψη μιας παρανομίας.

Είναι απλώς ηθικά καταδικαστέα γιατί χρησιμοποιείται για φοροαποφυγή στη χώρα της εταιρείας. Χιλιάδες από αυτές που έγιναν γνωστό μέσω των Panama Papers ότι διατηρούσαν offshore, θα μπορούσαν να στηριχθούν στην νέα ευρωπαϊκή οδηγία ζητώντας την καταδίκη των δημοσιογράφων και των μέσων ενημέρωσης που δημοσίευσαν το όνομα τους. Eίναι προφανές ότι τα Panama Papers, δεν θα είχαν δημοσιευθεί ποτέ.

Ακόμη χειρότερα γίνονται τα πράγματα για άλλες υποθέσεις, όπως των LuxLeaks, που αποκαλύψαν ότι το Λουξεμβούργο ήταν- και παραμένει- φορολογικός παράδεισος σε βάρος των άλλων ευρωπαίων "εταίρων". Γιατί στη περίπτωση αυτή όχι μόνο δεν υπάρχει παρανομία, αλλά ο μηχανισμός της φοροαπαλλαγής ήταν ενορχηστρωμένος και νομοθετημένος από την κυβέρνηση και το κράτος του Λουξεμβούργου. Για αυτό άλλωστε ο whistle blower Aντουάν Ντετούρ όπως και ο Εντουαρντ Περίν, ο δημοσιογράφος που δημοσίευσε το σκάνδαλο Luxleaks, δικάζονται την επόμενη εβδομάδα στο Μεγάλο Δουκάτο του Ζαν Κλωντ Γιούνκερ.
