Αν υπήρχαν Εισαγγελείς δεν θα υπήρχαν Βενιζέλοι

Το Νοέμβριο του 2014, με μια κίνηση που κάποιος μπορεί να τη θεωρήσει κίνηση δημοσιογραφικού ακτιβισμού, ή αν θέλετε κίνηση με αποκοτιά και πείσμα για τον τρόπο που λειτουργεί η Δικαιοσύνη, κατέθεσα στην Εισαγγελία Αθηνών, μηνυτήρια αναφορά που αφορούσε τον Ευάγγελο Βενιζέλο.

Ο Βενιζέλος όχι μόνο είχε κρατήσει τη λίστα Λαγκάρντ έξι μήνες αφότου αποχώρησε από το Υπουργείο Οικονομικών, αλλά το είχε δηλώσει κιόλας. Δηλαδή για έξι μήνες, και ενώ δεν ήταν πια υπουργός, είχε τη λίστα στην κατοχή του και φυσικά ό,τι περιείχε αυτή. Στη Βουλή ο Βενιζέλος, όταν κατηγορήθηκε για την κατοχή της λίστας από το σημερινό πρωθυπουργό Αλέξη Τσίπρα, παραδέχθηκε πως εκτός από τη λίστα, είχε στην κατοχή του και τα απόρρητα αμυντικά σχέδια της χώρας.

Παρά τις προκλητικές παραδοχές του Βενιζέλου, κανένας εισαγγελέας, από καμία βαθμίδα της Δικαιοσύνης, δεν διέταξε προκαταρκτική έρευνα για τις παραδοχές Βενιζέλου που στην πραγματικότητα ήταν δημόσιες παραδοχές παρανομίας.

Όταν παραπέμφθηκε σε δίκη για τη λίστα Λαγκάρντ ο Γιώργος Παπακωνσταντίνου (όχι όμως και ο Βενιζέλος ως υπουργός γιατί δεν το θέλησε η ΝΔ), το Δικαστικό Συμβούλιο του Ειδικού Δικαστηρίου, γνωμοδότησε πως η λίστα Λαγκάρντ ήταν δημόσιο έγγραφο. Με την ευκαιρία αυτής της επίσημης γνωμοδότησης, βρήκα ένα “νομικό παράθυρο” για να κάνω αυτό που δεν έκαναν οι Εισαγγελείς της χώρας. Κατέθεσα μηνυτήρια αναφορά κατά του Βενιζέλου για όσο διάστημα κατείχε τη λίστα ενώ δεν ήταν Υπουργός, δεν είχε δηλαδή αρμοδιότητα. Αφού το Δικαστικό Συμβούλιο είχε αποφανθεί πως η λίστα ήταν δημόσιο έγγραφο και αφού ο Βενιζέλος είχε επίσης παραδεχθεί στη Βουλή πως την κατείχε χωρίς αρμοδιότητα, άρα είχε κάνει υπεξαγωγή Δημοσίου εγγράφου, ενώ υπήρχαν και άλλα αδικήματα που πιθανόν είχε διαπράξει και αφορούσαν τα προσωπικά δεδομένα όσων ήταν στη λίστα.

Η αρχειοθέτηση της μήνυσης κατά του Βενιζέλου, βρίσκεται στην Εισαγγελία Εφετών για έγκριση αρχειοθέτησης. Έχει ενδιαφέρον να δούμε αν ο Εισαγγελέας Εφετών που θα την αναλάβει θα καταλήξει τελικώς πως ο συνάδελφός του που την περιέφερε στα συρτάρια επί δύο χρόνια, έκανε πραγματικά καλή δουλειά και δίκαιη φαντάζομαι. Γιατί όπως θα έλεγαν και οι Ενώσεις Εισαγγελέων «οι εισαγγελείς κάνουν τη δουλειά τους και αποκλείεται να φοβούνται το Βενιζέλο».

Υπάρχει βέβαια και η οπτική γνωστού Εισαγγελέα ο οποίος με νόημα μου είπε χθες όταν έμαθε για την αρχειοθέτηση «αν υπήρχαν εισαγγελείς, δεν θα υπήρχαν Βενιζέλοι».

A response to misinformation on Nicaragua: it was a coup, not a ‘massacre’

There is so much misinformation in mainstream corporate media about recent events in Nicaragua that it is a pity that Mary Ellsberg’s article for Pulse has added to it with a seemingly leftish critique.
